De Waerde: AML client file

For bookkeepers, accountants, tax advisers and lawyers: the customer due diligence on a company under the Belgian anti-money-laundering law, documented and dated. Identification with a source per fact, the screening, the risk factors and a reasoned indication, ready to print or to file.

What is in the file?
  • Identification: name and other names, enterprise number, legal form, seat, incorporation, legal situation, activity and who binds the company under its articles, each with its source.
  • Directors and permanent representatives, with their other mandates, insolvencies there and director bans.
  • Shareholders and parent companies from the filed annual accounts, the acts and the LEI register, with their share and the chain of control, and the honest note that the UBO register is not public.
  • EU, UN, US and UK sanctions lists on the company's name, and what is not screened.
  • Risk factors (sector, age, address, foreign parent, recent changes, FPS Economy measures) and a reasoned indication.
  • A checklist for what you must record yourself: purpose of the relationship, identity check, UBO register, PEP check, your own assessment and the next review.

The indication supports your own risk assessment; it is not legal advice. Building, printing and filing the file needs a sign-in.
